Terms & Conditions of Sale

These Terms & Conditions of Sale (“Terms”) govern all purchases made
through the Ciacci Steaks website and form the contractual agreement
between the customer and the Seller.

By placing an order through our website, you confirm that you have read
and understood these Terms and agree to be bound by them, together with
any other terms or policies expressly referred to during the purchasing
process.

In these Terms, Kilometro 25 di Ciacci Giovanni & C. S.a.s. is referred
to as the “Seller”, “we”, “us” or “our”. The person placing an order is
referred to as the “Customer”, “you” or “your”.

These Terms apply to purchases of products offered through our online
store, including fresh, chilled, frozen and cured meat products and any
eligible non-perishable accessories offered through the website.

2. Eligibility and Customer Information

By placing an order, you confirm that the information supplied during the
checkout process is accurate, complete and up to date.

You are responsible for providing a valid delivery address, telephone
number and email address and for ensuring that any information required
for successful delivery or importation is correct.

Where local laws impose age, import, food-safety or other restrictions on
the purchase or importation of a product, you are responsible for
complying with those requirements.

3. Products and Product Information

Our products are natural food products. Depending on the individual
product, meat may be fresh, chilled, frozen or cured and may be cut or
prepared to order.

Product photographs are provided for illustrative purposes. Because meat
is a natural product, the exact appearance, colour, marbling, shape and
other visual characteristics may vary from one individual cut to another.

Where a product is sold by stated weight, the final weight may vary within
a reasonable tolerance of the stated quantity due to the nature of
preparation and cutting. Unless otherwise specified on the relevant
product page, the applicable tolerance is approximately ±5% of the stated
weight.

Product descriptions, ingredients, allergens, storage information,
preparation instructions and other mandatory product information should
be reviewed before purchase and may vary between products.

4. Prices, VAT and Currency

Product prices are displayed in Euro (EUR) unless otherwise stated.
Applicable Italian VAT is included in prices where required by law.

Shipping charges, where applicable, are displayed during the purchasing
process before you submit your order for payment.

For deliveries outside the European Union, the price shown at checkout
may not include import duties, customs charges, local taxes, veterinary
inspection fees or other charges imposed by the destination country.
These costs may be payable by the Customer and are addressed further in
the Customs and Import Duties section below.

We take reasonable care to ensure that pricing information is accurate.
If a clear technical or pricing error occurs, we reserve the right to
contact you before dispatch to clarify the error and, where legally
permitted, cancel the affected order and refund any amount already paid.

5. Product Availability

All orders are subject to product availability and our ability to legally
and safely deliver the selected products to the destination provided at
checkout.

Because certain products are fresh, seasonal or available in limited
quantities, an item displayed on the website may occasionally become
unavailable before an order can be fulfilled.

If we are unable to fulfil an accepted order because the relevant product
is unavailable, cannot be legally shipped to the destination or cannot be
safely delivered, we will inform you and refund any amount paid for the
affected order or product.

6. Order Process and Contract Formation

To place an order, you select the products you wish to purchase, provide
the requested delivery and billing information, review the order details
and submit the order through the checkout process.

Before submitting your order, you should verify the selected products,
quantities, delivery address, contact information, shipping charges and
total price.

After successful payment, we will send an order confirmation to the email
address provided at checkout. The sales contract is considered concluded
when we send the order confirmation, subject to any applicable mandatory
consumer rights.

An automated acknowledgement of receipt of an order does not necessarily
constitute acceptance where the order has not yet been confirmed by us.

We may refuse or cancel an order where there is a genuine reason to do so,
including product unavailability, payment failure, suspected fraud,
incorrect pricing, an invalid delivery address, food-safety restrictions
or destination-country import restrictions. Where an order is cancelled
after payment, amounts paid for the cancelled order will be refunded.

7. Payment

Payments are processed through Stripe, our third-party
payment service provider.

Depending on availability and the payment options presented at checkout,
Stripe may support payment methods including credit and debit cards,
Apple Pay, Google Pay and Link.

Payment card information is handled by the payment provider through its
payment infrastructure. We do not store full payment card numbers on our
own website servers.

An order will not be processed for dispatch until the applicable payment
has been successfully authorized or received.

8. Order Preparation

Products are prepared for dispatch in accordance with the individual
product requirements. Where a product is described as cut to order, the
relevant cut is prepared specifically for the Customer’s order.

Because fresh and chilled meat is perishable, orders are generally
prepared and dispatched in accordance with our shipping schedule and
cold-chain requirements.

Once preparation of a perishable order has begun, cancellation may no
longer be possible. This does not affect any mandatory legal rights
applicable to the Customer.

9. Shipping and Delivery

We ship orders using express courier services such as DHL Express and UPS,
depending on the destination, service availability and the shipping option
selected or assigned to the order.

Perishable products are packaged using insulated and temperature-conscious
packaging appropriate for the shipment.

Our standard shipping schedule is Monday through Thursday. Certain
destinations may have different dispatch or delivery schedules because of
weekends, public holidays, customs requirements, carrier restrictions or
food-safety considerations.

Estimated transit times are generally:

  • Italy: approximately next-day delivery.
  • European Union: approximately 24–48 hours.
  • UK, Switzerland and Norway: approximately 48–72 hours.
  • Other destinations: approximately 48–96 hours.

These are estimated transit times rather than guaranteed delivery times.
Actual delivery may be affected by carrier operations, weather, customs,
import procedures, destination restrictions and other circumstances
outside our reasonable control.

10. Delivery Address and Failed Delivery

You are responsible for providing an accurate and complete delivery
address and a valid telephone number or other contact information
required by the courier.

If delivery cannot be completed because the address supplied is incorrect,
incomplete or inaccessible, or because the recipient is repeatedly
unavailable, the courier may make additional delivery attempts or hold
the parcel at an available collection point, subject to the carrier’s
procedures and the safe cold-chain window.

Customers should make reasonable arrangements to receive a perishable
shipment promptly. Where a product deteriorates because delivery could
not be completed due to circumstances attributable to the Customer, such
as an incorrect address or repeated unavailability, our Freshness
Guarantee may not apply.

This provision does not limit any mandatory consumer rights that may apply
under the law governing the transaction.

11. Receipt and Inspection of Perishable Goods

Because our products may be perishable, Customers should inspect the
external packaging and the condition of the shipment as soon as reasonably
possible after delivery.

If you identify a significant problem involving the cold chain, damaged
packaging, an incorrect item or a missing item, please contact us within
24 hours of delivery at

Please provide your order number and clear photographs of the shipping
packaging, product and relevant labels. This information helps us assess
the claim and, where necessary, investigate the shipment with the courier.

12. Risk and Delivery

For consumer purchases, the allocation of risk and responsibility for
loss or damage is subject to the mandatory consumer protection rules
applicable to the transaction.

Nothing in these Terms is intended to transfer risk to a consumer earlier
than permitted by applicable law or to exclude any statutory remedy
available where goods are damaged, defective or not in conformity with
the contract.

Where a delivery problem results from circumstances attributable to the
Customer, including an incorrect delivery address or failure to make
reasonable arrangements to receive a perishable shipment, the applicable
remedies will depend on the circumstances and governing law.

13. Right of Withdrawal — Perishable Goods

The statutory right of withdrawal for distance contracts does not apply to
goods that are liable to deteriorate or expire rapidly. This exception is
provided by Article 16(d) of Directive 2011/83/EU and is reflected in
Article 59 of the Italian Consumer Code.

Accordingly, fresh, chilled and other rapidly perishable meat products
covered by this exception cannot ordinarily be returned simply because a
consumer has changed their mind.

This statutory exclusion concerns the right of withdrawal only. It does
not affect mandatory legal remedies that may apply where products are
defective, damaged, incorrect or otherwise fail to conform to the
applicable sales contract.

The European consumer-rights framework expressly recognizes exceptions to
the withdrawal right for certain goods because of their nature, including

14. Legal Guarantee of Conformity

Where applicable, consumers benefit from the mandatory legal guarantee of
conformity provided under Italian consumer protection legislation,
including the applicable provisions of the Italian Consumer Code.

The legal guarantee is separate from our voluntary Freshness Guarantee
described below. Nothing in these Terms limits or excludes any mandatory
statutory rights or remedies that cannot lawfully be excluded.

15. Freshness Guarantee

In addition to applicable statutory rights, Ciacci Steaks provides a
voluntary Freshness Guarantee for eligible orders.

If an order arrives with a significant cold-chain or temperature-control
issue, damaged packaging that may have affected the product, or an
incorrect or missing item, please notify us within 24 hours of delivery.

Claims should be sent to

and should include the order number, a description of the problem and
clear photographs of the packaging and affected products.

Where a claim is confirmed under the Freshness Guarantee, we may provide
a replacement shipment or a refund, depending on the circumstances,
product availability and the appropriate remedy.

We aim to review and resolve valid claims promptly, normally within one
business day after receiving the necessary information.

16. Customs and Import Duties

Ciacci Steaks ships worldwide, subject to destination-country food,
customs, veterinary, import and carrier requirements.

For deliveries outside the European Union, the Customer may be responsible
for import duties, customs charges, local taxes, veterinary inspection
fees and other charges imposed by the destination country.

The Customer is responsible for checking whether meat or other ordered
products can legally be imported into the destination country before
placing an order.

Some countries and territories prohibit or restrict the importation of
meat and other animal-origin products. If we determine that an order
cannot legally or safely be shipped to the destination, we may cancel the
order and refund amounts paid for the affected order, subject to any
applicable legal requirements.

Delays caused by customs authorities, import inspections or destination
country procedures may affect estimated delivery times.

17. Refunds

Where a refund is due under these Terms, our Refund & Returns Policy
or applicable law, the refund will normally be issued to the original
payment method used for the purchase.

Refund processing times may depend on the payment provider and the
Customer’s bank or card issuer. Once a refund has been processed by us,
the time required for the funds to appear in the Customer’s account may
vary.

18. Force Majeure

We will not be responsible for delays or failures in performing our
obligations where caused by circumstances beyond our reasonable control,
including severe weather, natural disasters, strikes, transport or
carrier disruptions, customs restrictions, government measures, border
closures, infrastructure failures, public emergencies or other comparable
events.

Where a force majeure event affects an order containing perishable
products, we will take reasonable steps to protect the products and
communicate with the Customer where appropriate. Nothing in this section
limits any mandatory statutory rights or the Freshness Guarantee where
applicable.

19. Limitation of Liability

We are responsible for losses and damage to the extent required by
applicable law.

Nothing in these Terms excludes or limits liability where such exclusion
or limitation is prohibited by law, including liability for death or
personal injury caused by negligence, fraud or fraudulent
misrepresentation, willful misconduct, gross negligence where applicable,
or any other liability that cannot lawfully be excluded or limited.

For consumers, mandatory statutory protections and remedies applicable to
the transaction remain unaffected by these Terms.

20. Intellectual Property

Unless otherwise stated, the content of the Ciacci Steaks website,
including text, photographs, graphics, logos, product descriptions,
designs and other materials, is owned by or licensed to us and is
protected by applicable intellectual property laws.

Website content may not be copied, reproduced, distributed, modified or
commercially exploited without our prior written permission, except where
such use is permitted by applicable law.

21. Website Availability and Information

We make reasonable efforts to keep the website available and the
information displayed on it accurate and up to date. However, temporary
interruptions may occur because of maintenance, technical problems,
hosting issues or circumstances outside our reasonable control.

We may update product information, availability, prices, delivery
arrangements and website content from time to time. Changes do not affect
orders that have already been accepted except where required or permitted
by applicable law.

22. Privacy and Cookies

Personal data collected in connection with orders and use of the website
is processed in accordance with our
Privacy Policy.

Cookies and similar technologies are used in accordance with our
Cookie Policy and, where required, your cookie
preferences.

23. Consumer Protection and Mandatory Rights

If you purchase as a consumer, nothing in these Terms is intended to
exclude, restrict or replace mandatory consumer protections applicable to
you under the law.

Where the mandatory law of your country of residence provides you with
rights or remedies that cannot be contractually excluded, those rights
remain unaffected by these Terms.

Any provision of these Terms that is found to be invalid or unenforceable
under applicable law will be interpreted or modified to the minimum extent
necessary to make it valid, without affecting the validity of the
remaining provisions.

24. Governing Law

These Terms are governed by Italian law, without prejudice to any
mandatory consumer protection provisions that apply in the Customer’s
country of habitual residence.

Where the Customer is a consumer, the choice of Italian law does not
deprive the Customer of protections that cannot be excluded under the
mandatory law applicable to the Customer.

25. Jurisdiction and Dispute Resolution

For consumer contracts, jurisdiction will be determined in accordance with
the mandatory jurisdiction rules applicable to the consumer and the
transaction.

For non-consumer transactions, the competent courts will be determined in
accordance with applicable Italian law and the contractual relationship.

Before initiating formal proceedings, customers are encouraged to contact
us so that we can review and attempt to resolve any issue relating to an
order or our services.

Please note that the former European Union Online Dispute Resolution
(ODR) platform is no longer available for new complaints. We therefore do
not present the former ODR platform as an active dispute-resolution
channel in these Terms.

26. Changes to These Terms

We may update these Terms from time to time to reflect changes to our
products, services, delivery arrangements, legal requirements or business
practices.

The version applicable to an order is the version in force when the
contract is concluded, unless a change is required by mandatory law or
otherwise agreed with the Customer.
